When an Uninsured Driver is At Fault
This article will discuss what to do when an uninsured driver is partially at fault for a car accident.

BriefingWire.com, 6/27/2018 - If you are involved in a car accident with an uninsured driver and they are partially at fault for the accident there are a number of options available to you.

If you get into a car accident with an uninsured driver and it turns out that they are partially responsible for the accident you have at your disposal two main options:

1. Sue the uninsured driver for damages or

2. You could file a claim for uninsured motorist benefits under your own car insurance coverage

When it comes to suing an uninsured driver this is generally not worth your while. The main reason for this is that most uninsured drivers have little or no money or assets, therefore, while you might win the lawsuit, the uninsured driver is likely to have no money to make payment on the judgement. As the saying goes “you cannot get blood from a stone”.

The most likely outcome of an accident with an uninsured driver is that of filing an uninsured motorist claim. In most cases this is a much better way to proceed if you are injured by an uninsured driver. When filing an uninsured motorist claim you file a claim with your own car insurance company under the uninsured motorist coverage provision of the policy. One of the things that is important to understand when filing an uninsured driver claim against your insurer is to do it as soon as possible. This is because some insurance policies place strict deadlines for notifications of any potential uninsured motorists and the deadlines could be extremely short from the actual accident incident.

One expert noted that, “it is not uncommon for a driver to tell you that he or she has no insurance, however, this may not necessarily be true. That driver may be trying to get out of reporting the accident to his or her own insurance. In order to prove that the driver does not have insurance call the police and have them come to the scene of the accident. The police will check the department of motor vehicles database from the scene and figure out whether the driver has car insurance coverage.  Another option is to ask your own insurer to check whether the other driver has car insurance as insurance companies in many states have access to motor vehicle insurance databases.”

Note that uninsured motorist claims work pretty much in the same way as a regular car accident claim with the exception that the claim is against your own insurance company. Your case will be assigned to an insurance adjuster who will evaluate the case just like a regular car accident claim. One lawyer noted that, “it is of the utmost importance to remember that while it is your insurance company that you are claiming against they are not necessarily on your side, therefore, do not assume that the insurance adjuster is your friend and must act in the same way as you would had it been a regular car accident claim.”
