Miami Judge Grants Final Approval in David J. Stern Class Action

Fort Lauderdale, FL – U.S. District Judge Robert N. Scola, Jr., entered an order on June 8, 2012, granting final approval of the class action law suit involving foreclosure attorney David J. Stern for violations of federal labor laws by his former employees.

Stern, P.A., DJSP Enterprises, Inc., and Stern’s affiliated foreclosure processing businesses. The Plaintiffs alleged that Stern and his co-defendants violated federal law by terminating hundreds of employees in mass firings without the notice required by law. The subject law – the Worker Adjustment and Retraining Notification Act or WARN Act – is intended to ensure that employees are given 60 days advance notice of mass layoffs. The settlement provides a fund of $500,000 to provide a pro rata payment of wages to these former employees.

The precarious financial positions of the corporate defendants made it challenging to recover significant relief for the class of fired workers. “Given the challenges presented by the defendants’ financial circumstances, we’re pleased to have obtained such meaningful relief for the Class”, said Steven Jaffe commenting on the settlement. The settlement was well received by the Class as reflected by the fact that no objections or requests for exclusion were filed.
