Sydney - Due to unsure economic conditions, more people have to work beyond retirement age, and that brings along a number of concerns regarding their rights in terms of workers compensation. People want to know whether they are covered in the event of a workplace accident or injury, and the answer really depends on when the injury took place.

If the worker was younger than retirement age and covered by Works Compensation, he would be entitled to weekly payments. However, the payments will cease on the day the employee reaches retirement age.

Another question many ask, is whether cover immediately ceases upon turning 65. When an employee reaches retirement age, or is older than that when a workplace injury occurs, he will still be entitled to workers compensation for up to 12 months of the date of incapacity. Therefore, payments for reasonably necessary medical and other expenses may still be payable for up to a year after the weekly payments cease. However, this does not apply to seriously injured workers.

Employers remain liable for workers compensation insurance for each calendar year of employment, even after the employee has reached the age of 65.
