Stryker Hip Recall Lawsuits Exceed 100, as Federal Consolidation Considered

BriefingWire.com, 4/01/2013 - New York,1st April 2013 - Court records indicate that more than 100 Stryker Rejuvenate hip recall lawsuits have been filed in state and federal courts since the July 2012 announcement of the Stryker Rejuvenate recall for Rejuvenate and ABG II Modular-Neck Hip Stems, Bernstein Liebhard LLP reports. At least 81 claims stemming from the Stryker Rejuvenate recall are pending in a consolidated proceeding in New Jersey’s Bergen County Superior Court. According to a petition filed February 19th with the U.S. Judicial Panel on Multidistrict Litigation (JPML), another 30 Stryker lawsuits have been filed in 12 federal districts. The Petition seeks the establishment of a federal multidistrict litigation for all federally-filed claims in U.S. District Court, District of Minnesota.

Stryker Hip Recall

Approximately 20,000 hip components were involved in the Stryker hip recall. According to the company’s recall notice, the metal hip stems are prone to fretting and corrosion at the modular-neck junction. This can cause patients to experience pain, swelling and adverse local tissue reactions. According to the Motion filed with the JPML, many plaintiffs in Stryker Rejuvenate lawsuits have already undergone painful and risky revision procedures to have failing hips removed and replaced.

In a recall update issued in January, Stryker advised that patients fitted with the recalled Rejuvenate components undergo metal ion testing and cross sectional imaging, even if they are not experiencing symptoms of a failing hip implant. Some patients have experienced high levels of metal ions in their blood and/or adverse local tissue reactions, even in the absence of symptoms. The company also announced it had retained Broadspire Services, Inc., a third-party claims administrator, to handle medical claims and address out-of-pocket costs relating to the Stryker Rejuvenate hip recall.
